The issue the way I understand it now though is whether there was some agreement that his ex was supposed to move to Slovenia and live there with their kids, as opposed to it being an extended visit/holiday/maternal stay.

Thats not how the laws work. Depending on which state you live in, father’s just get every other weekend if they were not married. Luka was never married. And in many cases a mother can move wherever they want to, especially if its where her family is and a job opportunity.

so I am not a lawyer but I think a big part of the problem is that jurisdiction goes by wherever the children are. So as long as the children are in Slovenian they have jurisdiction over them. If she lets them visit here then he can just run to court here. So she refuses to let him leave the country with the kids. Also can she even live in the USA. She was probably under his visa and now they are not together.Its a complicate case when multiple countries are involved
