They’re arguing that they’re offering “option contracts” which are securities and thus under federal regulation, not the states.

Normally options are related to the stock market. You can buy an option on a certain stock going up or down. They’re trying to extend this logic to what they call “event contracts.”

It’s not established whether event contracts (which includes sports) are actually securities or not. IIRC the 3rd Circuit said yes but the 9th said no. SCOTUS will probably rule on this in the next year or two.

Personally I think the argument is ridiculous. They clearly advertise what they’re doing as sports betting and they’re not targeting investors. I don’t think we should even let retail investors buy options anyway.

It’s about who can create market. A gambling site only the house can set the price. A prediction market anyone can set a price and see if someone is willing to take them up on the offer. If you don’t understand this concept then yes you’re gonna think it’s not different but if you understand the math then it’s a huge difference. And NY only cares because they tax the crap out of the betting sites

The debate is that these “sports events contracts” are “sports gambling”, which is currently regulated by individual states. Hence, those “sports contracts” are illegal.

Ultimately, this whole debate is over if the CFTC has regulatory power via the Commodity Exchange Act to allow and regulate “sports events contracts”.

Sports gambling isn’t going away. For a state like NY, it’s mostly about if they can collect tax revenue.

Tbh, the prediction market structure is better bc there isn’t any house risk, truer odds and more liquidity/better price discovery. But, that structure can still exist on a state-by-state basis.

For those unaware, the state of NY collects 51% from licensed Sportsbook in their state. This isn’t about doing what’s safe. If that’s the case, they’d realize what a drain really is casinos are on the vast majority of poor degens, as they’re building a casino in the heart of queens next to Citifield.

Tribal entities have it on lockdown in my state. They want the poor degens to themselves. But they throw out the term health and safety when they mention any other form of gambling or betting being extremely unsafe and unhealthy.
