negotiations between investigators and the investigated are literally a foundational part of US law

almost every single case of a defendant who is being investigated on a case from a plaintiff will feature negotiations on possible resolutions…

i.e. settlements: plea deals, cooperation agreements or immunity agreements, corporate injunctions (basically voluntary compliance to trade a legal investigation for an audit), etc

even in cases where none of these resolutions enact…. they’re at least brought up and negotiated as it’s literally in practice a fiduciary obligation

note: the criminal prosecutor does not have a fiduciary duty to offer settlements or pleas (not like the same way the defence lawyer has a fiduciary duty to advise on settlement or pleas), but they do have fiduciary obligations to the public good which includes not clogging up the judicial system which in practice means they do have an obligation to how effectively a resolution is found (i.e. docket pressure)… AKA to negotiate

that’s why something like 90-95% of ALL US CASES end via negotiated disposition

(and it’s higher like 98% for federal cases = plea deals)

Yeah that was a pretty dumb statement lol. Those of us in that space have seen everything from a dumb DUI to pretty serious organized crime charges negotiated between the prosecution and defense. Regardless of money or influence.

Many times the prosecution side is actually the more willing party to negotiate when they know the facts of the case barely give them enough to meet the more likely than not threshold to win in court and they know the defendants also don’t wanna go through that.

I also appreciate his tenacity for this case but I really have come to hate the way he’s presented a lot of this and done so with the explicit intent of driving subscribers to his channel.

Prosecutors and investigators are two different groups of people though. Prosecutors shouldn’t be negotiating deals before the investigation is over.

Typically, you don’t negotiate with police investigators while they’re investigating. You negotiate afterwards with the prosecutors.

Not really? In the corporate world where your investigation is due to the public’s interest, you wouldn’t really announce your investigation is over prior to levying punishment. You’d put out a press release saying “we’ve found so and so and decided to take action by ___”. Like yes the investigation is concluded before you decide on a punishment but you wouldn’t declare it over prior to that

I don’t think the average fan cares that much about justice being served in this case. I mean the end of the day Kawhi is gone, the Clippers for the most part were dog shit so even in the worst case scenario it had minimal impact on the league.

We can act like this is going to open the floodgates to loopholes and salary caps but the reality is if you’re an owner you’d have to be a complete idiot to try that anytime soon. My guess is even if they don’t find a punishable offense in this case, in the coming months the league will refine the language or implement new rules that will prevent a mess like this from happening again.
