They could’ve probably honored the deal and paid it out but not count it on the cap if he died of way more common circumstances.

It should absolutely be voided for cap purposes.

Googled it and they did fix it in the 1995 CBA and it looks like this death by controlled substance clause is how Brandon Clarke’s contract is voided.

So because of Reggie Lewis, the Grizzlies are able to get out of Clarke’s contact

Are we comparing injury to drug overdoses now? It’s very sad and my heart goes out to his family but getting hurt ON the job vs doing drugs OFF the job are 2 totally different scenarios.

And his team took out an insurance policy that paid probably 80% of his salary.

NBA contracts need an injury clause to be voided and those aren’t common.

I’d say it’s a similar case - two guys who breach contract with their choice of actions and affect their careers (and thus earnings) permanently as a result. My guess is Jay didn’t get that money.

On the other hand you have Chris Bosh who had a medical condition he could do nothing about - there is no question he should get the payout in that case.

Seems pretty clear when this comes out days after the autopsy is national news . 

Anything cap-related is reasonable to share publicly even if it’s the result of something tragic.

For a contract this size there would have been extensive medical underwriting. If he had substance abuse issues at the time of purchasing they would have been known.

Also the contestability period for a life contract like this would have been 2 years, which he would have been past.

I would say so if it wasn’t basically a self-inflicted death. Sad either way but from a business standpoint I wouldn’t pay either. If he was battling with a health issue or some random freak accident then sure.

NBA players are allowed to smoke weed and I guarantee these eagerly heartless dorks would be playing accountant if that weed was unexpectedly laced.

Even if they did make that rule, I don’t think a situation like Clarke’s would qualify. For example, a player who fails drug tests for a drug of abuse gets kicked out of the league and immediately has their contract voided.

I mean he didn’t get hit by a car. He overdosed on drugs. I’m sure there’s some type of character clause in his contract that makes this an easy out for the team.

Is it really surprising? Isn’t it a very clear breach of contract? There’s likely a clause in the contract that outright states that. What if the player gets caught with drugs and goes to jail - should the team still be paying him? What if a player does steroids and gets banned from the league - should the league still be paying him?

His family won’t be fine. They lost him forever. Forget the money

There was no “coverage” back then and the other owners forced the Celtics to carry Lewis’s (20%) cap charge for three seasons.

Memphis isn’t paying out the contract because drugs are prohibited by the CBA and Clarke’s cause of death violates the terms of the contract.
