It’s the Olympic mountains to the West. Incoming moist air from the ocean has to either go North or South to get over them. Open carry laws in Texas require the firearm to be in a holster, and his gun wasn’t in a holster. Whether or not open carry is a good idea in the first place (I think it’s a terrible idea personally), the holster requirement is in place because it’s the best standard for safety since most handguns dont have a manual safety. If it’s in a proper holster, having it loose in the car as he did isn’t a safety issue (just as far as the pistol itself is concerned), because nothing can access the trigger, but unholstered, just imagine a loaded pistol bouncing around on the passenger seat when you hit a pothole and snagging the trigger on something.

Correct but he was in his car and the gun was besides him on the passenger seat. In the spectrum of danger of unholstered guns, this is as low as it gets. This is like ticketing someone for not quite stoping at a stop sign when there’s no car in sight. Most people understand the importance of a stop sign while also understanding that you don’t need to fully stop, swish your head around left and right. And then start moving again at every stop sign under every circumstance.

There’s a good reason not to slack on standards like “stop at stop signs”: otherwise everyone will rationalize why they’re the exception, and they’ll often be wrong. (Maybe you’re never wrong–if so, good for you! But since a lot of people can’t be trusted to get it right, you ought not boast about rule bending publically.)

But even disregarding that, how much of a menace do you think a multi-millionaire is such a threat to society with an unholstered gun that you have an officer at the time to ARREST him in a system where the court system is already backuped as is? As in, is this an offense that warrants a warning, maybe a ticket of some kind? Or does Harden need to actually be taken to the station and post bail and stuff? My guess is the officers in that jurisdiction have a standing rule to arrest anyone for that offense. IE there is no discretion which in that case the handled it exactly as they should. The PO and justice system should treat all equally. That means no special treatment for a guy like Harden but also no distreatment either. I bet you would have been arrested in the same situation. While i absolutely agree with the holster requirements that Harden wasn’t following, and agree that being loose in the passenger seat isn’t as low risk as others seem to think, guns absolutely do not misfire all the time. True misfires are exceedingly rare and most “accidental” shootings are cases of pure negligence, not of mechanical fault or failure. There isn’t a pistol on the market that i would expect to just go off even when dropped or tossed around, with the exception of the Sig P320. Nearly every single case of a gun “just going off” actually involve improper handling.

Guns in and of themselves are much safer than the people handling them

In this case I’m assuming it’s a concealed carry violation - if you have a gun in the car it’s considered to be concealed unless it’s unloaded and put somewhere not immediately accessible like the trunk.

Disclaimer: this is the law in my state - might be different in Texas but I can’t really see what other violation he could’ve been committing.
