I was curious about what the penalty might actually be and just looked it up. It’s on page 51 here, Article 36:

The team may have to pay the opposing team 2.5 million, pay the NBA a fine of 5 million, or both.
There’s no mention of lost draft picks or anything else. It’s not a small financial penalty, but that’s all the NBA can do with their current rules.

that’s for not appearing, but there would be other issues for hurting the integrity of the game. everyone in the NBA has a clause that they are supposed to uphold the integrity and it could be some people’s jobs.
I mean, those are the only penalties they have listed in their own rulebook. They know a team just not appearing for any reason hurts the integrity of the game, which is why the fine is so high. But they weighed the possibility of t his happening when writing these rules and the fine is all they included.
If a team did this, the owner and President of the team would have to OK it, so what jobs could possibly be lost? The NBA wouldn’t be able to take anybody’s job since they don’t have that possibility in their own rules as a penalty. The NBA can’t just make up new penalties when they feel like it, there are legal contracts at play here.

The lost revenue on a single game wouldn’t be massive but it would open Pandora’s Box, and that’s exactly why Adam Silver would (and would be right to) go nuclear scorched Earth on whatever team tries to open that box. If you start having teams forfeiting regularly you’ll start losing massive revenue, both in-arena and TV revenue. It’s already a problem with tanking (hence why we’re having these long drawn-out arguments about how to stop tanking), but this would bring the whole NBA down if forfeiting becomes the norm.

There’s even an added complexity that makes it different and entertaining.
The team scoring in their own basket gets to inbound the ball again. Which means the opposing team gets possession only when they force a turnover or get an “offensive” rebound. And when they do they’re going to need a fast break to shift the game back into their half.
Fouling in the bonus would also be a great way to get possession back. Because the fouled player goes to the free throw line and has to intentionally miss and his team really needs to get the rebound or else the opposition get a 3v2 advantage under their own basket.

If they change possession it can ONLY be on their defensive side of the court. Because if they tried to take it from their offensive side back to their defensive side they would be called for a backcourt violation. They’d have to chuck a shot from behind the halfcourt line.

So let’s say a team manages to steal the ball, can’t enter their half and chucks a long shot. But here aren’t you better off aiming for the boards? Cause it should count as a shot attempt and you just have to grab the “defensive” rebound and score in your own basket within 10 seconds? Higher chance than attempting a half court three, airballing it and turning over possesion.

So in this case would the defender of every scorer be credited with points? Would scoring a lot of points in this game actually just be a sign that you played bad defense? Is there anyway a variation of rules could work where if at a certain point in the season, with two teams this far down in the standings, with clear incentives to both lose, the winner gets the chance to improve their draft odds instead of the loser. It doesn’t really fix tanking, but it avoids a game where both teams have out suck each other.
I’m sure there’s gonna be holes in this idea, but man, let’s just save everyone’s time because of both teams are finding creative ways to lose, you could just flip a coin for the lottery odds for this specific game.
There is, it’s called the Gold Plan. In it, you get draft points for every win after being mathematically eliminated from the playoffs, and those draft points (at least partially) decide where you are in the lottery. The guy who originally proposed it did so for the NHL, which has a similar number of teams and games as the NBA (but no play-ins). The PWHL (women’s hockey league) currently uses it.
Makes no sense, cause tanking would then begin right at the start of the season
Teams that go into a season knowing they have no hopes for playoff success are tanking basically from the get-go anyways, but in this system, those teams would get eliminated from playoff contention the earliest, after which point they would have to spend more of the season actually trying to win. And for teams that weren’t trying to tank from the start but unfortunately had their season ruined because of injury luck or something, they wouldn’t just give up on the season and go from trying to throwing.
So, this system wouldn’t completely eliminate tanking, but it would strongly cut down on it, especially as the season continues. Near the end of the regular season, basically every team would be trying their best to win, either for a better playoff seed or for a better lottery position (unless their seed was already locked because they’re so far apart from the rest).
That said, there are problems I see with implementing the Gold Plan in the NBA. The addition of play-ins means that it takes way too long into the season for even completely terrible teams to get mathematically eliminated. Also, the system was made with a hockey-style point system in mind (where losses are treated differently from OT losses), and so specific details about it would have to be rethought when applied to basketball standings perhaps.
A potential fix is to not only consider when a team is eliminated from playoff contention, but eliminated from being in the top N (for some N < 8) in the conference. So for example, if you can’t make the top 2, you start gaining 0.25 lottery points per win (if you end up not making the playoffs), and if you can’t make the top 4 then you gain 0.5 points per win, and if you’re eliminated, then you gain 1 lottery point per win. That way, even a middling team is always trying to win, either for the partial lottery points if they fail to make the playoffs later on, or just to get a better playoff seed if they’re still in the running for it.
We just need the ultimate incentive: RELEGATION.
Sure it wouldn’t work for a number of reasons: contracts, TV deals, courts etc, BUT: if we ignore all those pesky details, relegation would solve everything naturally.
The issue with relegation is that theres nobody to promote. Cant promote G league teams because they have stuff like the South Bay Lakers playing in a 750 seat practice facility
