Silver is partially responsible for the CBA. I know that this clause was surely a demand by the NBPA, but the potential problems were evident.

It was the league’s job to find some way to satisfy every party without screwing someone, and the current rules clearly screw the teams trading for a player without getting full information on them. Teams are already obligated to share medicals and other personal information to ensure that both sides know the status of the player being traded, it’s not good that a player can suddenly be unavailable for other reasons, that are known at the time of the trade, and the “buying” team is completely unaware of that.

He’s not blaming Silver for the CBA (although, he could). He’s blaming Silver for allowing the Hornets to trade a player that was under a federal investigation (that he presumably knew about) and providing the Heat no recourse when that resulted in them getting NOTHING for the trade.

Trading for terry was one of the worst trades of the last 5 years even if he was the most vocal anti-gambling advocate in the sport.
