I expect them to cheat, I just don’t expect them to implement rules for the whole point of spending less money, and then break them for the purpose of spending more money. If someone were to cheat this way, it would be to try to get a leg up on the competition and make their team better.

The caps are absolutely there to level the playing field, and were implemented to help sustain the NBA as a profitable concern. That’s why they were voted in by the owners in 1983, a completely different atmosphere than today. But those same owners (well, different owners now) don’t feel constrained by the cap because they don’t feel constrained by any contract or law. They just see it as an obstacle.
If I’m a small owner, I yell like hell because the cap is there to help me. But Balmer doesn’t give a shit about it. And plenty do because it helps them, but the moment they think there is an advantage in going around it, they will.

As far as I understand, helping out with sponsorships isn’t cap circumvention. That’s what happened in this situation, but it was done in an extremely dumb way. Even the Raptor’s ownership group came out and said that’s what Kawhi wanted. Did they sound the alarm then? No, they tried to get Kawhi his extra money. If there was no extra money players wouldn’t sign with NY or LA, they would only sign with low tax teams like they do in NHL.

As a warrior fan, I do find it a bit sus that especially during the dynasty period, Lacob was hooking players up with all his VC connections. While it wasn’t as blatant as straight up giving players millions of dollars for no-show partnerships and did carry some risk, getting access to high profile startups’ early funding rounds by partnering with well known VCs had to have been pretty lucrative to the players, and isn’t the type of financial deal that any other random basketball player would have access to.

What I actually think will happen is the league will void Kawhi’s contract, but they won’t do it until after the deadline for Kawhi to join another team and be eligible for the playoffs so he can’t go sign for the vet min with a team and change the power dynamics of the league. Then in the off-season, every team will be able to make moves for him, but no one will have his bird rights.
The max fine for the Clippers is like $7.5M, so that would be easy enough to do and Ballmer wouldn’t think twice. The real thing will come down to the picks. I would probably go 5 picks like the Joe Smith deal, but space them out every other year starting in 2030.

Had the money Kawhi was paid via Aspiration been on the salary cap, the additional luxury tax bill would have been millions and millions for each other team, so by circumventing the cap, he also circumvented hundreds of millions of dollars in luxury tax payments. There should be a mechanism for the league to calculate that and make him pay that to the other teams.

To me, the most damning part of that episode was that Ballmer invested more money into Aspiration, at the exact same valuation as before, after Aspiration was already having trouble paying its bills to other creditors not named Kawhi, right before paying Kawhi the full amount.

That the investigators are seeking his sources indicates they do not have those same sources yet. Why would someone cooperating with an investigation NOT say what they told the reporter who put it in the podcast
What it indicates is that they are seeking all available information. They’re not bringing Pablo in because they know he has information they don’t. They bring him in because they know he has information, and they want to compare that to what they already know.
In all likelihood, there’s probably a very big overlap in what both parties know, but if Pablo has anything they don’t it would be great to add to their pile. It’s due diligence, not them asking for something “because they didn’t find it”. Since Pablo and his team have been working on this a while there’s a good chance they have something the investigation doesn’t, but whether it’s significant is a different story.

There was just a new podcast by Pablo Torre on which he shares that he was contacted by and shared information with the lawyers investigating the situation. He shared some of what he could but made it very clear they signed a strict NDA on pretty much everything that occurred once he stepped into the building, not even confirming whether or not he ever sat down there. The big thing I took from it, though, was that this was all very much a sophisticated plan, at least on the Clippers/Balmer side, and not a quick “let’s have them pay our guy don’t isn’t us” scheme.

I understand in the short attention span-era, this would seem done and dusted, but that’s not the case. There is new information all the time from whistleblowers and before any punishment, the facts need to be corroborated from multiple sources and the accusations need to be iron-clad.
